Terms of use for the sample programs associated with the book “Object-oriented Programming with SIMOTION”

The sample programs contained in this book have been created to illustrate specific issues and shall be understood as such. The use of the examples requires an engineering environment of at least SIMOTION SCOUT V4.5.

Regarding the software, the user is granted the non-exclusive, non-transferable, gratuitous right of using the software, which includes the right to change the software, to copy the unchanged or changed software as well as to combine it with its own software.

This software was not subject to the usual system test that Siemens AG normally provides for software. Any claims against us - based on whatever legal reason - particularly owing to software errors, or errors in the related documentation, or damage resulting from consultation, shall be excluded unless in cases where there is mandatory liability in case of intent, gross negligence, personal injury, bodily harm or damage to health, owing to the acceptance of a guarantee for the quality of an object, fraudulent concealment of a defect or breach of essential contractual duties. 
The above provisions do not imply a reversal of the burden of proof to customer’s detriment.
The laws of Germany shall apply. The place of jurisdiction is Erlangen.
