1. Subject of the agreement

1. The “mySupport-Dokumentation” application offered free of charge by Siemens enables users to compile documents ("Documents") using the documentation and/or manuals written by Siemens. Users can download documents via "mySupport-Dokumentation" in a variety of formats (PDF, RTF, XML, etc.).
2. The user may opt to be informed automatically and at no charge whenever the documentation and/or manuals required by the user to compile Documents are updated by Siemens ("Updating Service"). No legal entitlement exists to the Updating Service which is provided by Siemens voluntarily and can be terminated by Siemens at any time without notifying the user.
3. The description of the product features and characteristics is not determined by the Documents compiled with the help of "mySupport-Dokumentation" but exclusively by the documentation and/or manuals created and provided by Siemens for this purpose which can be found at https://support.industry.siemens.com/.

2. Rights of use

1. Provided that the user legitimately possesses and uses Siemens automation and drives products as well as the hardware and/or software described in the documentation and/or manuals, the user shall have the non-exclusive right – unlimited in time and location – to compile Documents using “mySupport-Dokumentation” and to reproduce and use reasonable quantities of such Documents exclusively for own and internal purposes; said Documents shall not be passed on to third parties.
2. If the user fits or equips machines, equipment or apparatus ("Products") manufactured and/or marketed by or on behalf of the user with automation and drives products from Siemens and with the hardware and/or software described in the documentation and/or manuals, the user shall have the non-exclusive right – unlimited in time and location – to use, modify or reproduce the Documents or parts of the Documents for the purpose of creating documentation and/or manuals for the user's Products, including the equipment of such Products and their combined use with Siemens automation and drives products and with the hardware and/or software described in the documentation and/or manuals ("Product Documentation"), and to transfer the same to third parties in hardcopy and/or electronic form as part of the Product Documentation. The user shall, however, only transfer Product Documentation with Documents or Product Documentation containing Documents together with the complete Siemens documentation and/or manuals.
3. Unless explicitly allowed, Documents or their contents may not be used, exploited, reproduced, passed on or marketed in any form.

3. Warnings, copyright notices, trademark rights

1. On no account shall safety, risk and hazard warnings contained in the documentation and/or manuals be removed.
2. The user shall refrain from removing Siemens copyright notices from Documents. If the user exercises the rights of use pursuant to 2.2, the user shall use suitable means – e.g. by attaching an additional and separate copyright notice – to demonstrate that the documentation has been modified.
3. The user is not entitled to use the SIEMENS name or brand and shall remove in their entirety any references to the Siemens name and/or brand in the Documents or parts of Documents reproduced by the user where such Documents are included in the Product Documentation. If use is made in Product Documentation of specific product-related Siemens brands, appropriate reference shall be made in the Product Documentation to the fact that such brands belong to Siemens AG (e.g. "SIMATIC is a registered trademark of Siemens AG").

4. Limitation of liability, disclaimer and indemnity

1. The contents of the documentation and/or manuals shall be examined to verify that they correspond with the hardware and software described. Any changes which may be necessary are contained in the updated versions. It is not possible, however, to fully exclude deviations from the contents of "mySupport-Dokumentation" and/or the hardware and/or software as well as mistakes in the information or incomplete information.
2. The Documents compiled by the user are cost-free excerpts from the documentation and/or manual written and provided by Siemens for this product. The user shall bear all responsibility and risk for compiling the documents. In this respect, Siemens disclaims all liability for Documents compiled by the user. The liability of Siemens in all other respects is defined in the latest version of the General Terms of Use which can be found at https://www.siemens.com/corp/en/index/terms_of_use.htm.
3. The user shall bear sole responsibility for marketing the Documents contained in the Product Documentation.
4. The user shall indemnify Siemens against third party claims which may be asserted against Siemens on the basis, as a result of the use of, or in connection with Documents contained in the Product Documentation.

5. Supplementary provisions

1. Unless specified otherwise in the above, the use of "mySupport-Dokumentation" and the Documents is subject to the latest version of the General Terms of Use which can be found at https://www.siemens.com/terms_of_use.
